2.3. AI-Powered Nature & Third-Party Reliance

2.3.1. AI-Generated Experience: You acknowledge and agree that Astro247 is an AI-powered platform and the insights, predictions, and other outputs generated by our Services are provided by artificial intelligence and machine learning models. These outputs are generated automatically based on the information you provide and are not the result of human interpretation or psychic ability. The quality and accuracy of these AI-generated outputs are dependent on the underlying technology and programs we utilize, which are supplied by third-party providers. As such, we do not guarantee the continuous performance, accuracy, or reliability of these outputs.

2.3.2. No Human Interaction: Astro247's platform, including all chat functions and consultation services, is fully powered by artificial intelligence. There is no human involvement, interaction, or intervention in the generation of content, responses, or predictions delivered to you. You are interacting solely with an AI-powered system that utilizes machine learning and information from various external, publicly available sources to generate its responses. The Services are not a substitute for human judgment or professional consultation.

3. User Account and Registration

3.1. To access certain features, you must register for an account. You agree to:

4.2. NEVER disregard professional medical or legal advice or delay seeking it because of something you have read or received through our Services. The predictions and insights generated by our AI are not a substitute for professional consultation. You are solely responsible for your own life decisions and actions.

5. User Conduct and Responsibilities

You agree not to use the Services to:

• 5.1.2. Infringe upon the intellectual property or other rights of any third party.
• 5.1.3. Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• 5.1.4. Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• 5.1.5. Use the Services for any fraudulent or illegal purpose.
• 5.1.6. Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services.
• 5.1.7. Take any action that imposes an unreasonable load on our infrastructure.
• 5.1.8. Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.

6. Intellectual Property Rights

All content available on the Services, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, software, and the AI-generated insights and predictions, is the property of Astro247 or its licensors and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any personal data and birth chart information you provide. However, by submitting this information, you grant Astro247 a worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, and translate this data solely for the purpose of providing and improving the Services. This includes using your data to train and refine our AI models, in an anonymized and aggregated format.

6.3. License to Use:

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

7. Payments and Billing

7.1. Fees:

Certain Services, such as live consultations or premium reports, may require payment of fees. You agree to pay all applicable fees as described on the Service.

7.2. Subscription Services:

If you purchase a subscription, it will automatically renew at the end of each billing cycle until you cancel. You can cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

7.3. No Refunds:

All fees are non-refundable, except as required by law or at our sole discretion. We do not provide refunds for a User's change of mind, dissatisfaction with a prediction, or unused portions of a subscription.

7.4. Price Changes:

We reserve the right to change our fees at any time. We will provide you with reasonable notice of any such changes.

7.5. Payment Processing Compliance:

All payments for our Services are processed securely through our designated payment gateways and aggregators. Astro247 adheres to the policies and security standards mandated by relevant financial institutions, including those for Credit Card, UPI, and Netbanking transactions, as well as the terms of our Payment Aggregator partners. For detailed information on transaction processing, security, and privacy, please refer to the respective policies of the concerned payment aggregators, which will be presented to you during the transaction process.

8.1. Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information, including sensitive data like your birth details. By using the Services, you consent to the practices described in our Privacy Policy.

8.2. Data Sharing with Third-Party APIs:

To provide and improve the Services, the information you input, including your chat messages and birth details, may be processed by third-party application programming interfaces (APIs) and AI models on a need-to-know basis. This is essential for the functionality of our AI, such as generating responses and personalizing your experience. TO THE FULLEST EXTENT PERMITTED BY LAW, ASTRO247'S TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO OUR SERVICES OR THIS POLICY IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE SIX MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Astro247 and its licensors, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

12. Termination

• 12.1. You may stop using the Services at any time.
• 12.2. We may suspend or terminate your account or access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
• 12.3. Upon termination, all provisions of these Terms which by their nature should survive will survive, including without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

13.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

13.2. Dispute Resolution

The Parties shall attempt to resolve any dispute arising from the terms mentioned herein amicably through negotiations between senior executives. If the dispute is not resolved within thirty (30) days, it shall be referred to binding arbitration by a sole arbitrator appointed mutually by the Parties. The arbitration shall be conducted in Bangalore in accordance with the Arbitration and Conciliation Act, 1996. The award rendered shall be final and binding on the Parties. The language of the arbitration shall be English. Notwithstanding the foregoing, either Party may seek injunctive relief in any court of competent jurisdiction in Bangalore to protect its intellectual property or confidential information.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
